  1. GENERAL PROVISIONS<\/strong><\/li>\n<\/ol>\n\n\n\n

    1.1 These general terms and conditions of sale (hereinafter, the \u201cGeneral Terms and Conditions\u201d) apply to all sales of products (hereinafter, the \u201cProducts\u201d or the \u201cProduct\u201d) purchased through the website www.olioguglielmi.it (hereinafter, the \u201cSite\u201d).<\/p>\n\n\n\n

    1.2 The distance selling service described in these General Terms and Conditions is reserved exclusively for consumers (hereinafter, the \u201cCustomers\u201d or the \u201cCustomer\u201d), meaning natural persons acting for purposes outside any commercial, business or professional activity they may carry out.<\/p>\n\n\n\n

    1.3 The language available for concluding the contract is Italian.<\/p>\n\n\n\n

    1.4 The Customer is required to read carefully the General Terms and Conditions, which have been made available on the Site in a manner that allows the Customer to store and reproduce them.<\/p>\n\n\n\n

    1.5 Contracts concluded with Guglielmi Saverio Snc (as identified below) through the Site are governed by Italian law and, in particular, by Legislative Decree no. 206 of 6 September 2005 (hereinafter also the \u201cConsumer Code\u201d), by Legislative Decree no. 70 of 9 April 2003 (hereinafter also the \u201cE-commerce Decree\u201d) and, insofar as applicable, by Royal Decree no. 262 of 16 March 1942 (hereinafter also the \u201cCivil Code\u201d).<\/p>\n\n\n\n

    1.6 Guglielmi Saverio Snc reserves the right to amend the General Terms and Conditions of Sale by giving notice on this page of the Site. The applicable General Terms and Conditions of Sale are those in force at the time an order is placed. Any amendment shall take effect upon publication on the Site.<\/p>\n\n\n\n

      1. PRODUCT INFORMATION<\/strong><\/li>\n<\/ol>\n\n\n\n

        3.1 Information on the Products available for distance selling through the Site, together with the relevant product codes, is available on the Site www.olioguglielmi.it.<\/p>\n\n\n\n

        3.2 Product images may not perfectly represent the characteristics of the products and may differ in colour, size and accessory products shown. All supporting information for purchasing is to be understood as merely generic information material, not referring to the actual characteristics of an individual product.<\/p>\n\n\n\n

        1. PRICE<\/strong><\/li>\n<\/ol>\n\n\n\n

          4.1 Product prices include all taxes and duties, except for customs duties and other charges that may be applied by the customs authorities of the country of destination.<\/p>\n\n\n\n

          4.2 All prices are expressed in Euro.<\/p>\n\n\n\n

          4.3 Shipping costs are borne by the Customer, except for any promotions shown on the shipping costs page.<\/p>\n\n\n\n

          1. ORDERING PRODUCTS<\/strong><\/li>\n<\/ol>\n\n\n\n

            5.1 The essential characteristics and prices of the Products are set out in the offer relating to each Product.<\/p>\n\n\n\n

            5.2 Orders placed by persons who are not of legal age will not be accepted.<\/p>\n\n\n\n

            5.3 To purchase the Products, the Customer must fill in online and send to Olio Guglielmi the order form in electronic format. Registration with a username and password is optional. Customers who do not wish to register can still complete a purchase: only the data needed for delivery and, where applicable, invoicing of the order will be requested.<\/p>\n\n\n\n

            5.4 The Customer must place the Product in the \u201ccart\u201d, enter their personal details and shipping details and, after reading the General Terms and Conditions, with particular reference to the delivery charges, the procedures for exercising the right of withdrawal and the Privacy Policy, and having confirmed that they have read them, select the desired payment method and choose the \u201cConfirm order\u201d option.<\/p>\n\n\n\n

            5.5 Before submitting their purchase order, the Customer will be able to correct any data entry errors by following the editing procedure provided on the Site. In particular, the Customer may change the quantity and type of Products they intend to purchase, adding or removing one or more Products from the \u201ccart\u201d.<\/p>\n\n\n\n

            5.6 By submitting the order, the Customer acknowledges and declares that they have read all the information provided during the purchase procedure and that they fully accept the General Terms and Conditions.<\/p>\n\n\n\n

            5.7 Guglielmi Saverio Snc reserves the right to evaluate whether to accept the orders received. Guglielmi Saverio Snc will inform the Customer of any inability to accept the orders received within 30 days from the day following the one on which the Customer submitted the order, and will refund any amounts already paid by the Customer for the supply.<\/p>\n\n\n\n

            5.8 No contract shall be deemed concluded between Guglielmi Saverio Snc and the Customer if Guglielmi Saverio Snc has reasonable grounds to believe that the Customer is not acting out of an actual and genuine interest in purchasing the products ordered. In such cases, the order submitted by the Customer shall be deemed to have no effect. Guglielmi Saverio Snc will send the Customer an e-mail confirming that the Contract has not been concluded, and will also cancel any charge and\/or cost borne by the Customer.<\/p>\n\n\n\n

            1. PAYMENT METHODS<\/strong><\/li>\n<\/ol>\n\n\n\n

              6.1 The Customer may pay the price of the Products and the related delivery charges by credit card.<\/p>\n\n\n\n

              6.2 Payments made by credit card are accepted.<\/p>\n\n\n\n

              6.3 The transaction will be charged to the Customer\u2019s linked account only after: a) the data have been verified (on a secure server directly by the Bank; Guglielmi Saverio Snc will have no direct access to your data), b) authorisation of the charge has been received from the company that issued the credit card used by the Customer, and c) the availability of the Product has been confirmed by Guglielmi Saverio Snc.<\/p>\n\n\n\n

              6.4 If, for any reason, it proves impossible to charge the amounts due from the Customer, the sales process will be automatically cancelled and the sale automatically voided.<\/p>\n\n\n\n

              1. ORDER CONFIRMATION<\/strong><\/li>\n<\/ol>\n\n\n\n

                7.1 Upon receipt of an order, Guglielmi Saverio Snc will automatically send an acknowledgement of receipt by e-mail, summarising all the details of the order, the essential characteristics of the product ordered, its price, the amount paid, the existence of the right of withdrawal \u2013 indicating the time limits and procedures for returning the goods \u2013 the geographical address for submitting any complaints, and information on the assistance services and existing commercial guarantees.<\/p>\n\n\n\n

                7.2 Following receipt of an order, Guglielmi Saverio Snc will check the availability of the product ordered and that the other conditions of sale are met, and only after this check will it confirm acceptance of the order and the shipment of the product.<\/p>\n\n\n\n

                7.3 If Guglielmi Saverio Snc is unable to fulfil an order received, it will promptly inform the Customer.<\/p>\n\n\n\n

                7.4 Any right of the Customer to compensation for damages or indemnity is excluded, as is any contractual or non-contractual liability for direct or indirect damage to persons and\/or property caused by the non-acceptance of an order.<\/p>\n\n\n\n

                1. SHIPPING AND DELIVERY<\/strong><\/li>\n<\/ol>\n\n\n\n

                  8.1 Products purchased on the Site will be delivered to the address indicated by the Customer. The Customer may in any case request delivery of the products to a natural person of their choice. Deliveries to post office boxes will not be made.<\/p>\n\n\n\n

                  8.2 For each order placed on the Site, Guglielmi Saverio Snc issues an invoice for the goods shipped, sending it together with the parcel or by e-mail. The invoice is issued on the basis of the information provided by the Customer when placing the order. No changes to the invoice will be possible after it has been issued.<\/p>\n\n\n\n

                  8.3 Delivery charges are borne by the Customer and are shown separately on the Site and in the order form.<\/p>\n\n\n\n

                  8.4 All purchases will be delivered by the express courier with which Guglielmi Saverio Snc has entered into service agreements (hereinafter, the \u201cCourier\u201d), from Monday to Friday, excluding public and national holidays. Guglielmi Saverio Snc is not responsible for unforeseeable delays. Guglielmi Saverio Snc will send the Customer a confirmation e-mail once the Products have been shipped. In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code the Products will be delivered within 10 (ten) days, barring delays, and in any case no later than 30 (thirty) days from the day following the one on which the Customer submitted the order to Guglielmi Saverio Snc.<\/p>\n\n\n\n

                  8.5 The delivery times indicated are approximate.<\/p>\n\n\n\n

                  8.6 Delivery requires the presence of the Customer or a person authorised by them at the recipient\u2019s address indicated in the order. Upon delivery of the goods by the Courier, the Customer must check that the number of packages delivered matches that indicated in the delivery note and that the parcel is intact and has not been tampered with. Any damage to the parcel and\/or the Products, or any discrepancy in the number of packages, must be reported immediately by writing a reservation on the Courier\u2019s proof of delivery. Once the Courier\u2019s document has been signed, the Customer may not raise any objection regarding the external characteristics of the parcel delivered.<\/p>\n\n\n\n

                  1. DUTIES AND RESTRICTIONS<\/strong><\/li>\n<\/ol>\n\n\n\n

                    9.1 Guglielmi Saverio Snc is not responsible for any duties or purchase restrictions applied by the customs authorities of the countries of destination.<\/p>\n\n\n\n

                      \n
                    1. RIGHT OF WITHDRAWAL<\/strong><\/li>\n<\/ol>\n\n\n\n

                      10.1 Pursuant to Legislative Decree no. 21 of 21 February 2014, implementing Directive 2011\/83\/EU on consumer rights, the Customer may return the product purchased and obtain a refund of the purchase price actually paid, without any penalty and without giving any reason.<\/p>\n\n\n\n

                      10.2 The right of withdrawal consists of the right to return the purchased products to the seller and consequently obtain a refund of their purchase price.<\/p>\n\n\n\n

                      10.3 The right of withdrawal may be exercised within 14 days of receipt of the product, as follows:<\/p>\n\n\n\n

                      10.3.1 Before the expiry of the above time limit, the Customer sends a registered letter with return receipt to Guglielmi Saverio Snc, or submits another statement explicitly expressing the intention to withdraw. The notice may be sent, within the above time limit, by registered letter to Via Canosa, 443 \u2013 76123 Andria (BT), Italy, or by e-mail to: info@olioguglielmi.it<\/p>\n\n\n\n

                      10.3.2 After verifying that the conditions for exercising the right of withdrawal are met, the Guglielmi Saverio Snc customer service will contact the consumer to indicate where the intact products must be returned, within fourteen days, excluding public holidays and weekends, from the date of the withdrawal notice.<\/p>\n\n\n\n

                      10.4 The costs of returning the purchased products are borne by the consumer.<\/p>\n\n\n\n

                      10.5 If the value of the products has diminished as a result of handling other than that necessary to establish their nature, characteristics and functioning (for example: products that are damaged, not properly or completely packaged, or in which certain parts such as components, elements, accessories, packaging materials, boxes, documentation and\/or other items are missing or damaged), Guglielmi Saverio Snc will refund the Customer the purchase price less the amount of such diminished value.<\/p>\n\n\n\n

                      10.6 If the Customer returns products after the above time limit, or in the case of products that have been opened and\/or partially used and are not suitable for return, the right of withdrawal does not apply and Guglielmi Saverio Snc will return the purchased goods to the Customer, charging the Customer the shipping costs.<\/p>\n\n\n\n

                      10.7 Subject to the above limitations, Guglielmi Saverio Snc will refund the amount actually paid by the Customer by bank transfer within 14 days of receipt of the withdrawal notice.<\/p>\n\n\n\n

                      1. LACK OF CONFORMITY, WARRANTY AND REPLACEMENT<\/strong><\/li>\n<\/ol>\n\n\n\n

                        11.1 The legal warranties provided for by Articles 129, 130 and 132 of the Consumer Code apply to the sale of Products other than food products. To benefit from the warranty, the Customer must keep the invoice or, where there is none, the transport document.<\/p>\n\n\n\n

                        11.2 In the event of a lack of conformity of Products sold by Guglielmi Saverio Snc, the Customer must immediately contact Customer Service at the e-mail address info@olioguglielmi.it<\/p>\n\n\n\n

                        11.3 The Customer is entitled to have the conformity of the goods restored free of charge by replacement, or to an appropriate price reduction or termination of the contract.<\/p>\n\n\n\n

                        11.4 The Customer loses these rights if they do not notify Guglielmi Saverio Snc of the lack of conformity within two months of the date on which they discovered it. In any case, any action to assert defects not fraudulently concealed by Guglielmi Saverio Snc is time-barred twenty-six months after delivery of the goods.<\/p>\n\n\n\n

                        11.5 If the purchased product turns out to have been damaged during transport, the Customer may request its replacement within the strict time limit of 10 days of receipt.<\/p>\n\n\n\n

                        11.6 The Product to be replaced must be returned, in a normal state of preservation, to the following address: Guglielmi Saverio Snc, Via Canosa, 443 \u2013 76123 Andria (BT), Italy.<\/p>\n\n\n\n

                        11.7 Fulfilment of the new order is subject to the availability of the Products requested.<\/p>\n\n\n\n

                        1. ERRORS<\/strong><\/li>\n<\/ol>\n\n\n\n

                          12.1 The Product information provided on the Site is constantly updated. However, the complete absence of errors cannot be guaranteed.<\/p>\n\n\n\n

                          12.2 Guglielmi Saverio Snc reserves the right to correct errors, inaccuracies or omissions even after an order has been submitted, and to change or update the information at any time without prior notice.<\/p>\n\n\n\n

                          1. GOVERNING LAW AND JURISDICTION<\/strong><\/li>\n<\/ol>\n\n\n\n

                            13.1 These General Terms and Conditions are governed by Italian law and must be interpreted in accordance with Italian law.<\/p>\n\n\n\n

                            13.2 For disputes arising from the interpretation, validity and\/or performance of these General Terms and Conditions, the mandatory territorial jurisdiction shall be that of the Court of Trani.<\/p>\n\n\n\n
